1. Right of free termination of the contract According to the applicable rules, if you are contracting as a consumer, the customer has the right to opt for the free termination of the contract under the applicable legal terms. To exercise the right to terminate the contract, the customer can contact us via e-mail (apoioaocliente@elenco.com.pt) or through our contact form, regarding their decision to terminate this contract by an unequivocal declaration ( example: a letter sent by post or email). The customer must use the model resolution form, as shown in the Annex. However, the consumer may exercise the right of free withdrawal by any means, and the use of any of the aforementioned means is not mandatory. To respect the term of free termination of the contract, simply send your communication regarding your exercise of the right of withdrawal before the termination period of the contract expires. Effects of termination of the contract If the customer terminates the Contract, we will refund the amount paid for the products, including delivery costs to the original delivery location without undue delay and provided that it does not exceed the period of 14 days from the day it was informed of your decision to terminate this contract. We will make the refund through the same payment method that the customer used for the original transaction. In any case, the customer will not pay any fees arising from said refund. Notwithstanding the foregoing, we may retain the refund until we receive the products back, or until the customer demonstrates evidence that they have returned them. two. Contractual right to return products In addition to the legally recognized right of free termination of the contract by consumers, mentioned in clause 13.1 above, we grant the customer a period of 15 days from the date of confirmation of shipment of the products to return them. The Customer may exercise its right to return the products in accordance with the terms set out in clause 14.1 above to exercise the right of free termination of the contract. However, the customer must inform us of his intention to return the products and deliver the products to us within 15 days of confirmation of shipment. The contractual right to return products shall apply exclusively to products that can be returned under the same conditions in which the customer received them. No refund will be made if the product has been used beyond the simple opening of the respective packaging or if it has suffered damage, the item will be examined for smell, stains on the products, among others that presuppose misuse; therefore, the customer must be careful with the products while they are in their possession. Please return the item using or including the original packaging. It must also include all instructions, labels, documents and product packaging. In any case, you must deliver, duly completed, the receipt you received at the time of delivery of the product, together with the product to be returned. Upon return, the respective products must be returned as indicated free of charge: Returns by carrier:. When returning the product(s) by a carrier determined by us, you must contact us through our web form so that the product is delivered to the place of original delivery. You must ship the product in the same package received, with a printout of the e-ticket attached to the email with shipping confirmation. If you do not intend to return the products using the free option available, the customer will be responsible for the return costs. Please note that if you decide to return items to us upon collection, we will be authorized to charge you for any expenses we may incur. After examining the item, we will let you know if you are entitled to a refund of amounts paid. Delivery costs will be refunded when the contractual right to return the products is exercised within the contractually defined period, all products in question are returned. The return will be made as soon as possible and, in any case, up to 14 days from the date on which the customer informed us of his intention to return the products. Despite the above, we may retain the return until we receive the products back or until the customer demonstrates evidence that the products shipped. Defective products In cases where you consider that, at the time of delivery, the product is not in accordance with the provisions of the contract, the customer must contact us through our contact form, indicating the details of the product as well as the damage suffered and we will indicate what to do. You can return the product by delivering a printout of the e-ticket to a carrier sent by us, at your home, with a refund of the corresponding amount later. As legally established, instead of canceling the contract (and the consequent return of the goods and reimbursement), you may also choose to replace the product or repair it. Refund of price, replacement of the product, or repair of the product must take place as soon as possible and, in any case, within 30 days. The amounts paid for the returned products for any damages or defects, will be refunded in full and by the same payment method that was used to pay for the purchase. All rights recognized by the law in force will be safeguarded. 4. Variations that should not be considered defects The products we sell, especially those made by hand, often have the characteristics of the natural materials used in their production. These characteristics, such as variations in grain, texture, knots and colors, may not be considered defects or damage. On the contrary, you should count on their presence and appreciate them. We only select the highest quality products, but the features are unavoidable and must be accepted as part of the individual product appearance. 5. Right to cancel and return orders from abroad If you have ordered items from another EU Member State or other countries outside Portugal through this website, clauses 14.1 and 14.2, apply in the same circumstances. The provisions in this clause shall not affect your rights as a consumer and user, nor your right to terminate the contract. 6. Product warranty The warranty for products sold by Elenco is for life.
